Minutes of the Special Meeting on April 23, 2017

The meeting was called to order at 1:05 p.m.
1) President Terry Sterling and Don Artis reported that there was a good turnout for the Pothole Party held yesterday, April 22nd. There will be another one on May 20th at 10:00 a.m.
2) Don Artis reported for the Road Committee that there are 5 areas being considered for road repair this year. They are numbered in order of priority. You can see the areas marked on the road.
Area 1 – Near the circle at the end of Dairy Ridge Road. It is 124 feet long and needs to be widened some.
Area 2 – The section in front of Kims’ house
Area 3 – The section between Humes’ and Kims’
Area 4 – From Griegers’ house east
Area 5 – First part of Tom’s Creek Court
The hope is that at least Areas 1-4 will get done.
Don will also get a quote on digging out the ditch in front of the concrete pad, and possibly other areas where the ditch has filled in and water is not flowing correctly.
3) President Terry Sterling reported that Josh Grieger is looking to purchase some impervious surface area from another Lot as he has used up his allotment. Please let Josh know if you would be willing to sell him 500 square feet of your impervious soil allotment.
4) Treasurer Tom Perciaccante reported that all of last year’s dues have finally been paid. The HOA was previously asked about considering a hardship case. The Board consulted with a lawyer who recommended that language about others covering a hardship case NOT be included in the by-laws.
5) Don Artis presented the amended by-laws. A committee of Don Artis, Ted Nichols, Terry Sterling, and Tom Perciaccante updated the by-laws as they were 20 years old. The major changes are:
A) Language about garbage service being provided was removed.
B) The “declarant”, meaning Pagano, was removed throughout the document
C) “net earnings” was changed to “funds”
D) The HOA will no longer be required to meet in Orange County
E) All officers will be on the Board of Directors (the Treasurer was not previously)
F) Homeowners can petition for a Special Meeting
G) There is no HOA seal, so language referring to such was deleted
Ted Nichols moved that the amended by-laws be accepted. Sally Vose seconded. The vote was unanimous in favor of acceptance. The committee was thanked for their work.
President Terry Sterling will sign the by-laws, making them effective immediately.
The meeting was adjourned at 2:08 p.m.
